Terms of use and service
These terms cover two things: your use of repagevia.site, and the main terms that apply when you hire Repagevia for a redesign project. Each project also has a written quote and plan that sit alongside these terms.
Part 1: Using this website
Information on the site
The guides and other content on repagevia.site are general information for New Zealand businesses. They are not legal, financial or professional advice. We take care to keep them accurate and to cite our sources, but laws, standards and prices change. Check the sources and get advice before relying on anything for an important decision.
Illustrative concepts
The before-and-after examples on this site show fictional businesses. They are illustrations of an approach, not case studies, and they make no claim about results.
Tools
The redesign planner and migration checklist are provided free and as-is. They run in your browser. You are responsible for checking the brief or checklist they produce before relying on it.
Copyright
The text, design and code of this website belong to Repagevia unless stated otherwise. You may link to any page and quote short extracts with a link back. Please do not republish whole pages. Our typefaces are licensed under the SIL Open Font License, and the mail code behind the contact form is PHPMailer, released under the GNU Lesser General Public License.
Links to other sites
We link to legislation, regulators and other sources. We are not responsible for the content of those sites.
Acceptable use
Please do not use the contact form to send spam, attempt to break the site or send anything unlawful. We may block messages that appear automated or abusive.
Part 2: Redesign projects
These are the main terms that apply when you accept a Repagevia quote. Your quote sets out the scope and the fixed price for that scope; the written plan you approve in Stage 2 adds the page list, redirect map and timeline. If anything in the quote conflicts with these terms, the quote applies.
Scope
We will deliver the work described in the accepted quote and approved plan. Work not described there is outside the scope. If you ask for something outside the scope, we will tell you whether it affects the price or timeline and only proceed once you agree in writing.
Price and payment
The price in the quote is fixed for the scope described. The quote states whether GST is included. Payment is due in the stages set out in the quote, within the number of days stated on each invoice. If a payment is overdue, we may pause work until it is paid, after giving you written notice.
Your responsibilities
You agree to provide content, feedback, approvals and access to accounts in reasonable time, and to make sure you have the right to use any content, images or logos you give us. Delays in these can affect the timeline.
Approvals
Each stage ends with a written approval. Once a stage is approved, changes to it may be treated as outside the scope.
Ownership
Once the final invoice is paid, you own the custom design, custom code and content we create for you on the project. Until then, we keep ownership but you may review the work. Third-party themes, plugins, fonts, images and software remain under their own licences, and we list them in the handover notes. Domain names and hosting accounts should be in your name; if we set any up for you, we transfer them to you.
Fixing problems
If something we built does not work as described in the plan, tell us within 30 days of launch and we will fix it at no charge. This does not cover problems caused by later changes made by you or others, by third-party services or by hosting.
Consumer law
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those rights cannot lawfully be excluded. The Consumer Guarantees Act covers services usually acquired for personal or household use1. Where the CGA applies and we provide services to a business, it can only be excluded in writing, between parties in trade, where it is fair and reasonable to do so1. We do not seek to exclude it.
We aim to keep these terms fair and balanced. Standard form consumer contracts, and standard form small trade contracts (business contracts in a trading relationship worth up to $250,000 over any 12 months), are subject to the unfair contract terms rules, which the Commerce Commission enforces2.
Limits on liability
To the extent the law allows, our total liability for any claim relating to a project is limited to the amount you have paid us for that project. We are not liable for indirect losses such as lost profits. These limits do not apply where the law does not allow them, including rights under the Consumer Guarantees Act that cannot be excluded.
Ending a project
Either party may end a project by written notice if the other materially breaches these terms and does not fix the breach within 14 days of being asked. You may also end a project at any time by written notice. In either case, you pay for work completed up to the date of ending, and we hand over that work once paid.
Confidentiality
We keep information about your business confidential and only use it for your project. We will not name you as a client publicly without your written permission.
Disputes
If a disagreement arises, we will first try to resolve it by talking. If that does not work, either party may refer it to mediation before taking other action. These terms are governed by New Zealand law.

Questions about these terms can be sent to hello@repagevia.site.
